  6. freedom of speech only applies to individuals, when a TV station presenter says something untrue about an individual or company,
    that is the TV station talking and not an individual and if untrue is defamation or libel or slander.

    a big TV station has lawyers, and the lawyers are supposed to filter out litigious comments.

    the statement would need to be couched in disclaimers and as said in the above video you can also give the target of the bad words
    the opportunity to counter.

    ultimately the courts are interested in the monetary aspect, did the talk cause you to lose money,
    if it did without basis, you can sue them for lost revenue or reputational damage.

    so eg if Fox broadcasts that Bernie Madoff is a scumbag scam artiste, that isnt defamation because it is true!

    saying the voting machines are fraudulent where they arent is defamation. Fox would have to supply their evidence that the machines are fraudulent.
    I think the voting machines are vetted by the FBI or some other govt agency, so as they are government vetted, the courts will regard them as non fraudulent by default, Fox will have to demonstrate they are fraudulent, and Dominion etc wont have to prove they are nonfraudulent, as that has already been done by getting authorised.

    hearsay isnt good enough, a big organisation such as Fox has to play by stricter rules.

    a youtube blogger mouthing off about someone, would be given more lenient treatment and say asked to cease and desist, 
    and maybe to issue an apology.

Trump would NEVER have been able to make people believe his weak lies without Fox News hosts like Tucker Carlson, Hannity, Dobbs, and etc creating explanations and reverse engineering justifications. Fox is the true birth place of Trumpism.
    The fairness doctrine which made Fox News illegal should be reinstated. Reagan was the President who first started selling out democracy to the billionare class. Everything Trump and McConnell did the last four years was about empowering corporations to spend more money as campaign contributions without identifying the source. McConnell and the GOP don't want the American voters to have a say about their political futures unless they're billionaires or CEO's donating vast amounts of money to their political campaigns.

  9. I’ve paused the video at the Fox statement to say something… freedom of speech does not protect you from the consequences of that speech. You can defame a company without criminal prosecution for 3 months, but you cannot be protected from civil litigation, which is what is occurring here. A lawsuit doesn’t infringe on first amendment rights as it is nothing to do with criminalising speech. Congress has passed no law, but a judge may side with the people you defame… very different situations
